Terms of Use @ Fantastika Pixels

If you have been found guilty of not respecting my terms of use (or those of other artists), your membership will be terminated immediately without any refund and no chance to join again! You will also not be allowed to access any of my sites anymore! It's very important for you and for me that you read my terms of use very carefully before to sign-up to any of my protected area! These terms are rules you must follow throughout your membership here and even after your membership is expired. I don't added this page because I didn't have anything better to do... They are there to protect me as an artist but also to protect you as a member. Thank you!

As my visitors are mostly English speaking, I rarely use other languages to send my emails and my updates. So if you don't understand English at all, you will need to use a translator like Google Translator because I will not translate anything for you. Sorry! Thank you for your understanding!

GENERAL TERMS:

	You don't need to have a site to join Fantastika Pixels (unless for the AS IS Area). But if you have one, you must give me your URL and your site name. *I will NOT accept anymore members with only a LiveJournal, MySpace, Photobucket, Fotki or Yahoo Groups as their principal site!*
	You must display your membership badge on your site within 7 days after joining with an active link back to http://fantastikapixels.com. Your membership will be activated only when the logo will be up on your site.
	You must have all protection scripts already installed on your site. They must be everywhere you will display my graphics or those created with my tubes or lines: no right click, no image toolbar (IE) and no drag. You can find these scripts here.
	You can use my tubes on LiveJournal but ONLY my tubes and ONLY if the original artist allows the use of their graphics on LiveJournal. You can find a list of these artists here. You must give me the name of your account!
	For users of Photobucket or Fotki, your graphics must be in a password protected album or folder. You must give me the name of your account!
	You can't share your login informations (username and password) with anyone! *Your IP Address is saved and I check this information on a regular basis!* If you are caught to share your codes with someone else, your membership will be deleted immediately and I will contact everyone I know in the Graphic Community!
	There will be no full or partial refund if ever you are not satisfied with your membership or with what I offer inside any of my protected area. *So don't cry for a refund, because the answer will be NO and always NO!*
	The good manners are always required when emailing me. If you are not respectful with me, I will not be respectful with you as well! I just don't have time to waste with people like this!
	You can offer the result of your creations on your site for free or for sale. The results must be graphics that your visitors will can't modify, edit or transform into something else!
	You must have a valid email address to be able to receive my messages and your goodies because your membership could be revoked without any refund if I can't contact you! *If you change your email address, it's your responsability to let me know about the changes!*
	If you are unsure of what you can and what you can't do with my graphics, please email me before using them!
	I reserve myself the right to accept you or not as a member of my site!

IMPORTANT - PLEASE READ!

	If you don't agree with my terms of use, please don't sign-up for any of my protected area! You will save your money and my time..
	If you don't understand my terms of use or if you have any doubts or questions about them, please email me at fantastikapixels@gmail.com and I will try to clarify them for you..
	I reserve myself the right to modify any of these terms at any given time! It's your responsability to check for changes or updates! Don't email me if ever you are not agree with the new terms or changes.. Just let your membership expire and don't renew! *It's my site, not yours! So it's my rules, not yours!*

TUBES TERMS:

	You must provide an active link back to http://fantastikapixels.com everywhere you will use them.
	You can't modify them in any way! Included but not limited to: crop, resize, rename, recolor, etc... *The only changes allowed are to flip them and erase some pixels to fit your needs!*
	You can't use them to make outlines or other tubes.
	You can't use them to make offline products. Although they are free or for your personal use only! Included but not limited to: scrapbooking items, printables, stickers, etc...
	You can't just add a name on them and then offer them. You must add at least 2 other elements. *Add only boxes or blocks is not an original creation!*
	You can't use them in any "maker" such as "Dolls Makers" or "Blinkies Makers".
	You can use them with Quick Tag, Sig Machine or other scripts in that kind. But your sigtags must have a protection grid or be in a password protected area.
	You can't offer them AS IS on your site or elsewhere and you can't claim that you have colored them yourself.
	You can't share them on groups such as Yahoo Groups or Google Groups... *Only the results of your creations like sigtags or letters can be shared on these groups!*
	You can't make "premades" without text with my tubes. You must add "Sample", "Your Name" or something in that kind before offering them!
	You can't try to reproduce them and then claim the result as yours! Each tubes pack takes me time to make and I don't want to see copies anywhere else!
	I have the right to request that you remove all graphics made with my tubes that you display on your site or elsewhere and that you stop using them if I see that you don't respect my terms of use!

AS IS TUBES TERMS:

	You must also provide an active link back to the original artist (who colored the tubes) everywhere you will use them. Ex: Tubes by Museni - Offered by Fantastika Pixels.

	You must also provide an active link back to the original artist (who drawn the lines) everywhere you will use them. Ex: Lines by Museni - Offered by Fantastika Pixels.
	You can't modify them in any way! Included but not limited to: crop, resize, rename, recolor, etc... *The only changes allowed are to flip them and erase some pixels to fit your needs!*
	You can't use them as templates, models or patterns to make your own outlines.
	You can't use them to make offline products. Although they are free or for your personal use only! Included but not limited to: scrapbooking items, printables, stickers, etc...
	You can't just add a name on them and then offer them. You must add at least 2 other elements. *Add only boxes or blocks is not an original creation!*
	You can't use them in any "maker" such as "Dolls Makers" or "Blinkies Makers".
	You can use them with Quick Tag, Sig Machine or other scripts in that kind. But your sigtags must have a protection grid or be in a password protected area.
	You must color them before using them. When I say "color", I mean with "shading". *Only fill with a color is not enough!*
	You can't make tubes (gif, psp, psd, png, etc...) with the lines unless you have purchased a Tubing Licence from me!
	You can't offer them AS IS on your site or elsewhere and you can't claim that you have drawn them yourself.
	You can't share them on groups such as Yahoo Groups or Google Groups... *Only the results of your creations like sigtags or letters can be shared on these groups!*
	You can't use them on LiveJournal, MySpace, Facebook, Twitter or any other social sites...(Even if you have colored them yourself!) *IT'S A BIG NO-NO!!!*
	You can't make "premades" without text with my tubes. You must add "Sample", "Your Name" or something in that kind before offering them!
	You can't use them to create tutorials that you will offer on your site or on groups such as Yahoo Groups or Google Groups...
	I have the right to request that you remove all graphics made with the as is lines that you display on your site or elsewhere and that you stop using them if I see that you don't respect my terms of use!

SIGTAGS TERMS:

	You must provide an active link back to http://fantastikapixels.com everywhere and everytime you will use them. (Even if you use them only in your emails!)
	You can't modify them in any way!
	You can't take them into something else!
	You can't give or sell them on your site or elsewhere!
	You don't have no good reason to open them in any software to see how I created them!
	You can't use them on LiveJournal, MySpace, Facebook, Twitter or any other social sites... Some sigtags can be used on social sites. Be sure to read the informations under the sigtags to see if it's allowed or not!
	You can use them in blogs or forums if you provide an active link back to my site.
	You can't try to reproduce them and then claim the result is yours! Each sigtag takes me time to make and I don't want to see copies anywhere else!
	You can request up to 5 sigtags every week. All requests are usually filled during weekends. *Note: I'm in the middle to add all my sigtags to the Sig Machine so I can't fill any request for the moment!*
	You can't request sigtags for your family or your friends. *They will be personalized with your name only!*
	I have the right to request that you remove all sigtags that you display on your site or elsewhere and that you stop using them if I see that you don't respect my terms of use!

IM LETTERS TERMS:

	You can't take pieces of my im letters to make yours. Included but not limited to: graphics, templates, etc...
	You can't share, sell or offer them on your site or on groups such as Yahoo Groups or Google Groups... *They are for a personal use only!*
	You can't take the graphics or the templates of my im letters into a webset, a wp theme or anything else without my written authorization.
	You can't take my im letters into a version for Outlook or Windows Mail without my written authorization.
	You can't try to reproduce them and then claim the result as yours! Each letter takes me time to make and I don't want to see copies anywhere else!
	I have the right to request that you stop using them if I see that you don't respect my terms of use!

WEBSETS & WP THEMES:

	You must keep all credits links where they are everywhere you will use them.
	You must keep all scripts to protect the pages and the graphics everywhere you will use them.
	You can't modify them in any way! Included but not limited to: graphics, layouts, templates, stylesheets, etc...
	You can't create new graphics with mine. Included but not limited to: logos, banners, email graphics, headers, im letters, etc...
	You must add your site name on the blank graphics (header, banners, logos...) before using them. You can't use my websets or my wp themes with blank graphics! *Note: Due to lack of time and energy, I can't offer support or help to add your site name... Sorry!*
	You can't use them (or any graphics) on LiveJournal, MySpace, Facebook, Twitter or any other social site... *IT'S A BIG NO-NO!!!*
	If you host your graphics on Photobucket or any other site in that kind, they must be in a password protected album or folder.
	You can't take my layouts (websets) or the templates (wp themes) to create your own websets or wp themes. My layouts and templates are 100% original to me or have been purchased with the authorization to use them for profit.
	You can't give or sell them on your site or elsewhere!
	You can't take the graphics of my websets and create a wp theme without my written authorization and you can't do the otherwise either!
	You can't take the graphics and mix with other sets I have created or those of someone else! *They can't be used separately!*
	You can't try to reproduce them and then claim the result as yours! Each webset and wp theme takes me time to make and I don't want to see copies anywhere else!
	I have the right to request that you remove all websets and wp themes from your site or elsewhere and that you stop using them if I see that you don't respect my terms of use!

TUBING LICENCE TERMS:

	The Tubing Licence (or Special Tubing Licence) will allow you to make tubes with all the lines I offer in the Members Area and then offer the tubes on your site for free or for sale. *Without this Licence, you can use the lines for making end use graphics only such as sigtags, letters, websets, wp themes, adoptions etc...*
	You must have a site to purchase the Licence. You must give me your URL and your site name. *I will NOT accept anymore members with only a LiveJournal, MySpace, Photobucket, Fotki or Yahoo Groups as their principal site!*
	You must display your Licence everywhere you will offer your tubes with an active link back to http://fantastikapixels.com. A text link only is not allowed!
	You must display your Licence on your site within 7 days after purchase with an active link to http://fantastikapixels.com. A text link only is not allowed! The Licence will be activated only when it will be up on your site. *You can't offer the tubes on your site if the Licence is not activated yet!*
	You must also provide an active link back to the original artist (who drawn the lines) everywhere you will offer your tubes.
	The links (to my site and to the site of the original artist) must be on the same page! Not on a credits page only!
	You can't create tubes that you will offer with an AS IS Licence. *Your visitors and your members will not be allowed to offer them on their own site!*
	The dolls must be fully dressed (with clothes and hair) before offering them as tubes. You can't offer them naked, as bases or with underwear only!
	You can't rename the lines! If you make tubes with the lines "Lizzy", your tubes must be named "Lizzy" as well!
	The Licence is valid for 1 site only! If you want to offer tubes on several sites, you must purchase separate Licences for each site! *A discount is offered on the purchase of additional licences...*
	The Licence is valid for 1 member only! If you are more than one site owner for the same site, each owner must purchase a separate Licence. *Note: Other owners must also have been or be a member of my Members Area to get the lines! (Because you can't share the lines with your co-owners!)*
	The Licence is valid for Lifetime of my site... You can still make tubes with the lines even after your membership is expired!
	I have the right to revoke your Licence, to request that you remove all the tubes made with the lines that you offer on your site or elsewhere and that you stop making tubes with them if I see that you don't respect my terms of use!

COMMERCIAL LICENCE TERMS:

	The Commercial Licence will allow you to make websets with all the layouts I offer in the Members Area and then offer the websets on your site for free or for sale. *Without this Licence, you can use my layouts for a personal use only!*
	You must have a site to purchase the Licence. You must give me your URL and your site name. *I will NOT accept anymore members with only a LiveJournal, MySpace, Photobucket, Fotki or Yahoo Groups as their principal site!*
	You must display your Licence everywhere you will offer your websets with an active link back to http://fantastikapixels.com. A text link only is not allowed!
	You must display your Licence on your site within 7 days after purchase with an active link to http://fantastikapixels.com. A text link only is not allowed! The Licence will be activated only when it will be up on your site. *You can't offer the websets on your site if the Licence is not activated yet!*
	The links (to my site) must be on the same page! Not on a credits page only!
	The Licence is valid for 1 site only! If you want to offer tubes on several sites, you must purchase separate Licences for each site! *A discount is offered on the purchase of additional licences...*
	The Licence is valid for 1 member only! If you are more than one site owner for the same site, each owner must purchase a separate Licence. *Note: Other owners must also have been or be a member of my Members Area to get the layouts! (Because you can't share the layouts with your co-owners!)*
	The Licence is valid for Lifetime of my site... You can still make profit with the websets created with my layouts even after your membership is expired!
	Secret Phrase: I respect the terms of use!
	I have the right to revoke your Licence, to request that you remove all the websets made with my layouts that you offer on your site or elsewhere and that you stop making profit with them if I see that you don't respect my terms of use!

AS IS LICENCE TERMS (AS IS AREA):

	You can offer my tubes in your protected Members Area only! You can't offer them in your pixel shoppe or elsewhere!
	You can't offer the tubes you have flipped to increase your stats. You can only offer the tubes you have downloaded in the AS IS Area! *Ex: If a pack contains 200 tubes, you can't offer the flipped version to provide a pack of 400 tubes to your members!*
	You must display your membership badge with an active link back to http://fantastikapixels.com on the same where you will offer my tubes. A text link only is allowed if you use them to create graphics.
	You can offer my tubes on 1 site only! If you want to offer them on several sites, you must pay an additional fee of $10.00 per site. *A discount is offered if you are a current (not expired) member...*
	I have the right to revoke your Licence, to request that you remove all my tubes that you offer on your site or elsewhere and that you stop offering them if I see that you don't respect my terms of use!
